Acceptable Use Policy
This agreement is made between NittanyLink, Inc. ("NittanyLink") and the
Internet customer ("user").
NittanyLink reserves the right to change their policies at any time; therefore
this document should be read regularly and in its entirety. The current
acceptable use policy will be available on the World Wide Web at
http://www.nittanylink.com/aup.asp. All related correspondence should be
directed to support@nittanylink.com.
I. Network Policy
The Internet account provided by NittanyLink is for personal or business use by
one or more individuals living in the same house or location only. User shall
not provide password information to individuals not living in the same house or
location. The account is only permitted to establish one connection at a time;
simultaneous connections are not permitted.
User agrees to refrain from using NittanyLink's services to perform any
activities that are deemed illegal by the laws and regulations in the user's
location. User also agrees to abide by any laws, rules, and regulations imposed
on them by networks connected through NittanyLink's services.
User agrees not to remain connected to NittanyLink's services for an excessive
amount of time on a daily or monthly basis. Excessive is defined by NittanyLink
and is subject to NittanyLink's discretion. Connecting to, or remaining
connected to NittanyLink for periods of time during which user is not
performing any Internet related activities ("being idle") is deemed
unacceptable use, and the account may be disconnected upon NittanyLink's
finding of such activity.
NittanyLink is not responsible for any content downloaded, or e-mails received
from any network, including its own. User agrees to hold NittanyLink harmless
from any damaging content received by any means while connected to NittanyLink.
While NittanyLink attempts in good faith to provide reliable Internet Service,
there is no expressed or implied guarantee of 100% uptime. NittanyLink will not
be held responsible for any personal or business loss due to service problems
with NittanyLink, its partners or affiliates, or any network accessed through
NittanyLink.
II. Technical Support
NittanyLink's Technical Support for Internet Service is limited to the
following: Dial-Up Networking settings, Internet Explorer, and Outlook /
Outlook Express. NittanyLink will not offer free technical support with other
browsers/mail programs. NittanyLink also limits technical support active
NittanyLink customers in good standing. Support for Internet Explorer is
limited to being able to browse any single page available on the web. Support
for Outlook/Outlook Express is limited to NittanyLink's mail services only.
NittanyLink will also not offer free technical support for the removal of any
viruses, worms, trojans, adware, spyware, or any other malicious programs. If
any of these are discovered to be the issue with connection problems,
NittanyLink reserves the right to charge the customer for further technical
support with proper notification (either verbal, electronic or written) to the
customer.
NittanyLink's Technical Support for Web Hosting is limited to the following: The
first page of the domain is available to the world-wide web, working FTP access
(if applicable) and the incoming email server is working (if applicable).
NittanyLink is not responsible for the configuration of browsers, mail
applications or FTP applications.
III. Billing Policies
NittanyLink billing may be done by credit card, or debit/check card. User shall
provide appropriate account information and sign to authorize NittanyLink to
charge the account. User agrees to have the appropriate funds available in the
account at the time the payment will be deducted. Monthly Internet access is
currently $12.95 per month, $10.95/mth annually and $8.95/mth biennially,
subject to change with appropriate notice by NittanyLink. NittanyLink will
impose a charge of $12.95 on the date corresponding with user's billing cycle.
If there are insufficient funds in the account on that day, user will be
assessed an additional $20.00 fee.
Payments may also be made by cash (i.e., legal tender or personal check) by
dropping off in person or mailing appropriate payment to NittanyLink before the
payment due date. Payment is due at monthly, semi-annual, or annual intervals
starting from the date user enters into agreement with NittanyLink by signing
this document, or by verbal assent. NittanyLink Inc. reserves the right under
their agreement to turn off service following non-payment. NittanyLink is not
required under to give notice before suspending or terminating an account for
non-payment. NittanyLink imposes a $20.00 fee on all returned checks.
Refunds will not be given for partial months of service. Discounted rates for
prepayment are contingent upon the prepaid period being completed; as such, any
refund of prepayments will be calculated accordingly.
